McManimon, Scotland & Baumann, LLC (MS&B) is a member of the New Jersey Energy Coalition.   McManimon, Scotland & Baumann, LLC’s energy practice work spans the gamut, from representing electric and gas utilities building out critical power infrastructure projects to the entrepreneurs and businesses that are charting the path to the new energy economy using solar photovoltaic power systems, energy storage, and electric vehicles.  In between the two, MS&B also continues to counsel New Jersey’s towns, cities, counties, and school districts on everything from preparation of Requests for Proposals for energy audits and solar Power Purchase Agreements (PPAs) to Energy Savings Improvement Programs (ESIPs) and reverse energy auctions.  The Firm is frequently involved in helping districts implement energy efficient capital projects.

The Firm has been in the vanguard in seeking the legislation to permit these transactions and commenting on legislation, regulations and policy notices such as the Local Finance Notices that implement these programs. Tony Solimine, Andrea Kahn, Matthew Jessup and other attorneys have spoken on solar financing and renewable energy on numerous occasions and to a wide variety of audiences.  More recently, Firm attorneys Bhavini A. Doshi and Erin K. Law published an article on Municipal Climate Resilience and Bond Financing which was featured in the June 2019 edition of the New Jersey League of Municipalities Magazine.  Ms. Doshi was also recently appointed as Chair of the Renewable Energy, Cleantech and Climate Change Committee for 2019-2020 for the New Jersey State Bar Association.

One of the Firm’s notable public-sector energy assignments involved assisting the Bayonne Municipal Utilities Authority in a project financing of the City’s first wind turbine.  The 70-ton turbine was financed through funds from the New Jersey Environmental Infrastructure Trust (now the New Jersey Infrastructure Bank) utilizing funds provided by the American Recovery and Reinvestment Act of 2009. This turbine was the first in the tri-state metropolitan area when it came online in 2012 and powers one of the City’s pump stations.

The Firm’s private sector energy assignments include counseling PSE&G on negotiations with the Port Authority over construction the Bergen-Linden Corridor Upgrade Project, including installation of a new 345kV power substation at Newark Airport.  The Firm has also recently counseled the North Jersey District Water Supply Commissioner on the development of a hydropower project, floating solar project, and the adoption of a policy to use 100% Renewable Energy for its facilities and operations by 2024.
